🗂 Your Right to Access Immigration Documents (Even if a Consultant Applied for You)

If your immigration consultant or lawyer submitted your application and you never saw the full package, you still have the right to access it.

If your immigration consultant or lawyer submitted your application and you never saw the full package, you still have the right to access it. Many applicants worry when they realize they do not have access to the portal their immigration consultant or lawyer used. In Canada, even if a representative submitted your application through their own IRCC portal, you remain the owner of your immigration information. A licensed representative must act transparently and in your best interests, which includes giving you access to your documents when you ask for them. You can request copies of all forms submitted to IRCC, supporting documents, submission confirmations (such as AOR), and correspondence with IRCC, as well as any explanation or submission letters that formed part of your application. It is best to make this request in writing (for example, by email) and clearly list what you are asking for. While a small administrative fee may apply for copying, access to your documents should not be refused or unreasonably delayed. If your representative is not responding or refuses to share your file, you may have options to escalate, such as filing a complaint with the College of Immigration and Citizenship Consultants (for consultants) or the appropriate Law Society (for lawyers).
